Since 22 September 2026, updated Rules for Implementing the Extended Obligations of Producers (Importers) have been in force in Kazakhstan. The amendments were made to Resolution No. 763 of 25 October 2021 by Government Resolution No. 808 of 10 September 2026. They do not change the amount of the recycling payment. What changes is the procedure: how to submit an application, how quickly the operator issues an invoice and a certificate, on what grounds an application can be rejected, and how to correct an error in a document that has already been issued. For companies that import trucks, tractor units and truck-mounted machinery themselves, this determines when a vehicle can be registered.
Key points of the revised rules
- The certificate is electronic. The rules define it as a document in electronic digital form certified with an electronic digital signature (EDS).
- When obligations are fulfilled. For producers and importers that have signed a contract with the operator, from the moment they receive the certificate confirming payment of the recycling fee.
- A third party may pay. The rules explicitly allow the payment to be made by another person rather than by the importer itself.
- Other grounds for a certificate. It can be issued on the basis of a court decision, a notary's enforcement endorsement or a notice from the operator, once the required amount has reached the account.
- Exceptions. Producers with counterclaims against the operator do not make the payment in the usual way. For electric vehicles the payment calculation coefficient is zero, and their certificate is issued together with the invoice.
- Updated list of documents. The list of documents that producers and importers of vehicles and self-propelled agricultural machinery attach to the application has been revised, so it is worth checking your existing set against the operator's current requirements.
How the process now works
- The importer signs a contract with the extended obligations operator.
- It submits an application to make the payment and obtain the certificate, either through the operator's online portal or on paper.
- The operator checks the documents, calculates the amount using the approved methodology and issues an invoice within three working days.
- Once the full amount has been received, the operator issues the certificate within three working days.
For a vehicle, the certificate must be obtained before initial registration; it states the vehicle identification number (VIN) and the BIN or IIN of the producer or importer. For self-propelled agricultural machinery, the deadline is before initial registration and no later than 30 calendar days from the date of manufacture or import. After registration, the operator may recheck the data on which the calculation was based. If it finds a discrepancy that affects the amount, the shortfall must be paid within 30 calendar days.
When an application is refused and how to fix an error
An application will be rejected if the document package is incomplete or if the details in the application do not match the attached documents. For vehicles there is an additional ground: the operator has not been provided with an electronic passport with the status "incomplete" from the national electronic passport system.
An error in an issued certificate can be corrected: the application is submitted through the operator's online portal, and up to six working days are allowed for its review. A correction will be refused if there are no supporting documents, if a vehicle with the wrong number is already registered in the database of the Administrative Police Committee of the Ministry of Internal Affairs, or if the request seeks to change more than two characters of the identification or serial number. If the payment increases after the correction, the difference has to be paid.
Who is affected
The new procedure applies to all producers and importers that pay the recycling fee. The rules set out the procedure for vehicles and self-propelled agricultural machinery. Whether a particular machine, such as a crawler excavator or a loader, is subject to the payment depends on its classification, and this is best confirmed with the operator before import.
The September amendments should not be confused with the spring changes to how the recycling fee is administered, which Inbusiness.kz reported in June, citing the Ministry of Industry and Construction. Those changes applied only to machinery from Russia and Belarus: passenger cars, buses, tractor units, trucks and specialised machinery. Category X municipal cleaning vehicles, tractors, and grain and forage harvesters were not covered, and the conditions for imports from third countries, including China, remained unchanged.
At the time, players in the construction and road transport markets warned of a risk of heavy machinery shortages and rising prices for commercial vehicles. Vice Minister of Industry and Construction Olzhas Saparbekov said that no shortage of special machinery was expected in Kazakhstan, and the ministry stressed that there was no question of closing the market to imports.
What to do now
- Establish who the importer is. If the supplier is importing the machinery, ask for a copy of the certificate before paying the final instalment. If you are importing it yourself, sign a contract with the operator in advance.
- Check the electronic passport. For a vehicle, the operator must receive an electronic passport with the status "incomplete", otherwise the application will be rejected.
- Cross-check the numbers. The VIN or serial number in the contract, the invoice and the passport must match: a correction takes up to six working days, and no more than two characters can be changed.
- Build time into your schedule. The operator has up to three working days for the invoice and up to three for the certificate, plus time for payment, and all of this must happen before the machinery's initial registration.
- Keep the calculation. After registration, the operator may recheck the data and demand an additional payment within 30 calendar days.
